This section is used for declaring whether energy efficiency, innovation or SME considerations are taken into account in the procurement procedure (in procurement documents and their definitions and criteria). There is no exact definition as to what taking into account means. In practice, taking into account may mean that, for example, the energy consumption of the procurement object has been taken into account in the description of the procurement object or in the criteria for total economic affordability. Taking innovation considerations into account may mean that, for example, the contracting entity utilises innovation partnership or otherwise seeks to purchase a procurement object that, as such, has not been previously offered on the market. Taking SMEs into account may mean that, for example, the procurement has been divided into parts or that the principle of proportionality has been taken into account when the suitability requirements were imposed. The content of the declarations referred to in this section has no legal effect on the procurement procedure; the information will only be collected for statistical purposes.
